Gospl.chat (“Gospl”), operated by Reveris, Inc., a California corporation, is committed to maintaining the privacy of its customers.  In order to provide the best service to you (“You”) and its customers (collectively “Users”), Gospl needs to collect certain information from Users including some of your personal information through Gospl’s website (“Site”). Gospl does not share personal information, your data, or chats with third-party affiliates in order to provide its products and services (collectively “Products”) to You. Gospl is committed to maintaining the privacy of this information in accordance with the law, and all individuals with access to personal information about Gospl’s customers are required to follow this Privacy Policy.

Gospl is providing this Privacy Policy, to inform You of the information Gospl collects, how Gospl uses that information, and the choices You have regarding Gospl’s use of said information when you access the Site and use Gospl’s Products. 

1. Terms of Use

This Privacy Policy, as well as Gospl’s Terms and Conditions (“Terms”), govern your access and use of the Site and the use of the Products.  By accessing and/or using the Site and/or using the Products, You agree to all the terms and conditions of this Privacy Policy and the Terms, which are incorporated herein by reference. If You do not agree to all the terms and conditions of this Privacy Policy and the Terms, You are not authorized to use the Site or the Products provided therein.  By using the Site and the Products, You consent to Gospl’s collection, use and disclosure of your personal information and data in the manner described in this Privacy Policy. You may always opt not to disclose certain Personal Information, but this may restrict access to the Site’s features and the Products.

2.  Does Gospl Collect Personal Information?

Gospl does not collect personal information unless You submit inquiries or comments to Gospl, however, third party services, such as Google, may collect your information, as discussed below. Gospl uses this information to improve the Site and the Products and address correspondence sent by You. You control the type of and extent of all personal information submitted to Gospl.  While using the Products, Gospl does not maintain or collect, store or index any of your chats or any information/data that has been transferred by You. 

3.  Mode and Place of Processing the Personal Information

a.  Methods of processing

Gospl takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Personal Information, which is defined as Any information that directly, indirectly, or in connection with other information allows for the identification or identifiability of a natural person. Although Gospl implements reasonable security procedures and practices appropriate to the nature of the personal information to protect your personal information from unauthorized or illegal access, destruction, use, modification, or disclosure, due to technical limitations, GOSPL DOES NOT REPRESENT, WARRANT AND/OR GUARANTEE THAT PERSONAL INFORMATION WILL REMAIN SECURE. Therefore, Gospl cannot and does not guarantee, and You should not expect, that your Personal Information or private communications with Gospl will always remain private. Notwithstanding this, as a matter of policy, Gospl never sells any Personal Information or Sensitive Personal Information about You to any third-party.

b.  Legal basis of processing

Gospl may process Personal Information relating to Users if one of the following applies:

• Users have given their consent for one or more specific purposes. Note: Under some legislations, Gospl may be allowed to process Personal Information until You object to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of Personal Information is subject to European data protection law. 
• Provision of Personal Information is necessary for the performance of an agreement with  You and/or for any pre-contractual obligations thereof.
• Processing is necessary for compliance with a legal obligation to which Gospl is subject.
• Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in Gospl.
• Processing is necessary for the purposes of the legitimate interests pursued by Gospl or by a third-party.

In any case, upon your request, Gospl will help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

c.  Place

The Personal Information is processed at Gospl's operating offices and in any other places where the parties involved in the processing are located.

d.  Retention Time

Personal Information shall be processed and stored for as long as required by the purpose for which it has been collected as follows:

• Personal Information collected for purposes related to the performance of a contract between Gospl and You shall be retained until such contract has been fully performed.
• Personal Information collected for the purposes of Gospl’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by Gospl within the relevant sections of this document or by contacting Gospl.

Gospl may be allowed to retain Personal Information for a longer period whenever You have  given consent to such retention, as long as such consent is not withdrawn. Furthermore, Gospl may be obliged to retain Personal Information for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Information may be deleted. The right to access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after expiration of the retention period if the Personal Information has been deleted.

e.  The purposes of processing

The Personal Information is collected to allow Gospl to provide its Products, comply with its legal obligations, respond to enforcement requests, protect its rights and interests (or those of its Users or third-parties), detect any malicious or fraudulent activity, as well as the following: Interaction with external social networks and platforms, analytics, contacting You, managing contacts and sending messages, platform services and hosting, and location-based interactions.

Personal Information is collected only when You contact Gospl or use the Site as set forth below:

Cookies 

A cookie is a small string of information that a website that you visit transfers to your browser for identification purposes and can be used to follow your activity while using a website or across websites.   Gospl uses cookies while You are using the Site.  On the Site, Gospl also uses Google Analytics, which uses cookies. Google Analytics is a web analysis service provided by Google LLC (“Google”). Google utilizes the information collected to track and examine the use of this Site, to prepare reports on its activities and share them with Google and other Google services, including usage data, Personal Information, and the information from cookies. While using the Site, Google may use the Personal Information and other information collected to contextualize and personalize the ads of its own advertising network.

The place of processing is in the United States.

The category of personal data collected according to California Consumer Privacy Act (“CCPA”): internet information.  This processing constitutes a sale based on the definition under the CCPA.  For more information about Google Analytics, please visit www.google.com/policies/privacy/partners/ and www.google.com/analytics/learn/privacy.html. You can opt-out of Google Analytics' collection and use of data generated by your use of the Services by going to http://tools.google.com/dlpage/gaoptout. 

You can prevent the use of certain cookies by modifying your Internet browser settings, typically under the sections “Help” or “Internet Options.”  If you disable or delete certain cookies in your Internet browser settings, you may still access the Services, however, you might not be able to access or use important functions or features of the Services, and you may, for example, be required to re-enter your log-in details.  

Contacting You

Gospl may also collect Personal Information when You contact Gospl. By sending your Personal Information, You authorize Gospl to use these details to reply to requests for information, quotes or any other kind of request as indicated in the communication.

With Whom Gospl Shares Your Personal Information

Gospl does not share your personal information except as set forth below:

Gospl may disclose and exchange information so that Gospl complies with its legal and regulatory obligations.

Gospl may also need to share some personal information with other parties, such as potential buyers of some or all of Gospl’s business or during a re-structuring. Gospl will typically anonymize information, but this may not always be possible. The recipient of the information 

will be bound by confidentiality obligations.

Gospl will not share your personal information with any other third-party.

No Personal Information sold

Except as set forth above, Gospl does not sell to third-parties any personal information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

g.  No Collection of Personal Information of Minors 

Gospl does not knowingly collect personal information of consumers below the age of 18.  In the event that Gospl learns that it has collected personal information from a child under age 13 without parental consent, Gospl will delete that information as quickly as possible. If You believe that Gospl may have any information from or about a child under 13, please contact Gospl by e-mailing Gospl at the following e-mail address: support@gospl.chat 

4. The Rights of Users Overview

Users may exercise certain rights regarding their Personal Information processed by Gospl.  Users have the right to do the following:

• Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Information.
• Object to processing of their Personal Information. Users have the right to object to the processing of their Personal Information if the processing is carried out on a legal basis other than consent. Further details are provided in the dedicated section below.
• Access their Personal Information. Users have the right to learn if Personal Information is being processed by Gospl, obtain disclosure regarding certain aspects of the processing of Personal Information, and obtain a copy of the Personal Information undergoing processing. 

Please note that Gospl is not required to do any of the following:

• Retain any Personal Information about You that was collected for a single one-time transaction if, in the ordinary course of business, that information about You is not retained;
• Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information; or,
• Provide the personal information to You more than twice in a twelve  (12) month period.
• Protection Against Discrimination. You have the right to not be discriminated against by Gospl because You exercised any of your rights under the CCPA. This means Gospl cannot, among other things:
• Deny goods or services to You;
• Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
• Provide a different level or quality of goods or services to you; or
• Suggest that You will receive a different price or rate for goods or services or a different level or quality of goods or services.
• Verify and seek rectification. Users have the right to verify the accuracy of their Personal Information and ask for it to be updated or corrected.
• Restrict the processing of their Personal Information. Users have the right, under certain circumstances, to restrict the processing of their Personal Information. In this case, Gospl will not process their Personal Information for any purpose other than storing it.
• Have your Personal Information deleted or otherwise removed. Users have the right, under certain circumstances, to obtain the erasure of their Personal Information from Gospl. Subject to certain exceptions set out below, on receipt of a verifiable request from you, Gospl will:
• Delete your personal information from Gospl’s records; and
• Direct any service providers to delete your personal information from their records.

Please note that Gospl may not delete your personal information if it is necessary to:

• Complete the transaction for which the personal information was collected, provide a service requested by you, or reasonably anticipated within the context of Gospl’s ongoing business relationship with you, or otherwise perform a contract between You and Gospl;
• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
• Debug to identify and repair errors that impair existing intended functionality;
• Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
• Comply with the California Electronic Communications Privacy Act;
• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when Gospl’s deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided Gospl have obtained your informed consent;
• Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with Gospl;
• Comply with a legal obligation; or,
• Otherwise use your personal information, internally, in a lawful manner and in Gospl’s sole discretion, that is compatible with the context in which You provided the information.
• Receive their Personal Information and have it transferred to a third-party.  You have the right to receive their Personal Information in a structured, commonly used and machine-readable format and, if technically feasible, to have it transmitted to a third-party without any hindrance. This provision is applicable provided that the Personal Information is processed by automated means and that the processing is based on your consent or on a contract of which You are a part.
• Lodge a complaint.  You have the right to bring a claim before their competent data protection authority.

5.  Contact Information to Exercise Your Rights

Any request to exercise your rights must be submitted by e-mailing Gospl at the following e-mail address: support@gospl.chat.  After Gospl has verified your identity, Gospl will take.  If Gospl delivers its response electronically, the information enclosed will be "portable", i.e. delivered in an easily usable format to enable You to transmit the information to another entity without hindrance, provided that this is technically feasible.  Gospl may provide personal information to a consumer at any time, but Gospl will not be required to provide personal information to You more than twice in a twelve (12) month period.

6.  Your Right to Know and to Portability

You have the right to request that Gospl discloses to you the categories and sources of the personal information that Gospl collects about you, the purposes for which Gospl use your information and with whom such information is shared.

7.  Your Right to Object to Processing

Where Personal Information is processed for a public interest, in the exercise of an official authority vested in Gospl or for the purposes of the legitimate interests pursued by Gospl, You may object to such processing by providing Gospl with grounds for the objection.

You may, however, in the case of the processing of Personal Information for direct marketing purposes, object to that processing at any time without providing any justification. 

8.   Right to Limit Use of Personal Information

You have the right to limit the use of your Personal Information. 

9.  Your Request for Personal Information

Gospl will respond to any request made by You for your Personal Information.  

10.  Your Request to Delete Personal Information

You have the right to request that Gospl delete any personal information about You that Gospl has collected, and that Gospl direct any service provider to delete the Personal Information from Gospl’s records. Gospl will respond to any request made by You for the deletion of your Personal Information.  

Please note that Gospl is not required to comply with your request to delete your personal information in all instances. 

11.  Your Request to Correct Personal Information

Gospl will respond to any request made by You to correct your personal information.  

12.  Processing of Requests  

Any of the requests herein can be exercised free of charge and will be addressed by Gospl as early as possible, but always within one (1) month of receipt of your request.  You may submit a maximum number of two (2) requests over a period of twelve (12) months.  Gospl will confirm receipt of your verifiable request within ten (10) days and provide information about how Gospl will process your request. Gospl will respond to your request within thirty (30) days of its receipt. Should Gospl need more time, Gospl will explain to You the reasons why, and how much more time Gospl needs. In this regard, please note that Gospl may take up to forty-five (45) days to fulfill your request. Gospl’s disclosure(s) will cover the preceding twelve (12) month period. Should Gospl deny your request, Gospl will explain You the reasons behind Gospl’s denial.

13.  Verifiable Requests

For Gospl to respond to your request, it’s necessary that Gospl know who You are. 

Gospl will not respond to any request if Gospl are unable to verify your identity and therefore confirm the personal information in Gospl’s possession actually relates to you.

For California residents, if You cannot personally submit a verifiable request, You can authorize a person registered with the California Secretary of State to act on your behalf.

14.  Use of Personal Information for Legal Purposes

Personal Information may be used for legal purposes by Gospl in a court of competent jurisdiction, a judicial proceeding, an arbitration, or in the stages leading to possible legal action arising from improper use of this Site or the Products.

You acknowledge and agree that Gospl may be required to reveal Personal Information upon the request of public authorities.

15.   How “Do Not Track” requests are handled

This Site does not support “Do Not Track” requests. To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their respective privacy policies.

16.  Changes to the Privacy Policy

Gospl reserves the right to make changes to the Privacy Policy at any time by notifying its Users on this page. Gospl may also notify You of changes on the Site and/or by sending a notice to Users via any contact information You have provided to Gospl.  Gospl strongly recommends that You check this page often and refer to the date of the last modification to the Privacy Policy listed at the bottom of this page.   Should any changes affect processing activities performed pursuant to your consent, Gospl shall provide notice to You and a new consent, where required.

This Privacy Policy relates solely to this Site and the Products, if not stated otherwise herein.
